Philip John Bena and Steven Wick, each charged with possession of marijuana with intent to deliver and possession of heroin with intent to deliver, petitioned the circuit court for Kenosha county for a writ of alleging that the county court lacked personal jurisdiction over them because a search warrant issued for their premises was based on an insufficient affidavit, because the complaints against them were insufficient, and because the statute under which they were charged is unconstitutional. In a series of decisions, Circuit Judge Earl D. Morton denied the petition for a writ of . On July 8, 1973, on the basis of an affidavit submitted by Capt. William Schorn of the Kenosha police department, Court Commissioner V. J. Lucareli issued a search warrant for the premises at 2142-30th Avenue in the township of Somers, Kenosha county, occupied by Steven Wick. At approximately 10:00 p.m. on that date, the warrant was executed by officers of the Kenosha sheriff's department who seized marijuana, heroin and other evidence.
