Petitioner Baer is employed as manager of the Golden Cue, a pool hall in the city of Milwaukee. On June 29, 1965, petitioner Baer was convicted in county court for violating sec. 87-13.57 of the Milwaukee Code, enacted as part of Ordinance No. 326, regulating pool halls and billiard parlors located in the city of Milwaukee. He was fined $50 or, in lieu thereof, sentenced to thirty days in county jail. Petitioner chose jail and then brought a proceeding, alleging that his detention, restraint and imprisonment were illegal because the ordinance upon which this detention was based was unconstitutional.
